How to Buy USDT with UPI in India
USDT (Tether) is a stablecoin designed to track the US dollar. Indians use it to hold dollar value, receive payments from abroad and move money between wallets. UPI is the easiest way to pay for it, but how you use UPI matters a lot, both for safety and for tax. This guide covers the safer route, the riskier P2P route, and how to keep your USDT in the L-Pesa wallet.
⚠️ Crypto is unregulated and risky in India. The government has repeated that crypto products are unregulated, can be highly risky, and may offer no regulatory recourse if you lose money (Infinilex summary of the 9 Sep 2026 FIU-IND release; PIB release). Only use money you can afford to put at risk.
What USDT is
- A token issued by Tether that aims to stay at about 1 US dollar. It isn't legal tender in India and isn't a bank deposit.
- It runs on several networks: Tron (TRC-20), Ethereum, Polygon, Solana and others. L-Pesa supports USDT on Tron, Polygon and Solana, and USDC on Solana (l-pesa.in).
- In India, crypto counts as a Virtual Digital Asset (VDA) for tax (Income Tax Department).
Before you start
- PAN and Aadhaar (exchanges need them for KYC), plus a UPI-linked bank account in your own name.
- The L-Pesa app (Android), with a USDT deposit address ready.
- 2FA turned on for every exchange account.
Option 1 (safer): an FIU-IND registered exchange
Crypto platforms serving Indian users have to register with the Financial Intelligence Unit – India (FIU-IND) as reporting entities under the anti-money-laundering law (PMLA). The government gave Parliament a list of 54 registered providers as of 9 March 2026. It includes Indian exchanges such as CoinDCX, ZebPay, CoinSwitch, Mudrex, WazirX, Unocoin and Giottus, and offshore entities behind Binance, Bybit and KuCoin (Lok Sabha answer, annexure reproduced by CoinSwitch; Infinilex dated list).
Important: FIU registration is an anti-money-laundering obligation, not a licence or a government endorsement. India has no crypto licensing regime (same sources).
Typical steps:
- Sign up and complete KYC (PAN + Aadhaar).
- Add INR using the deposit methods the exchange lists. Many offer UPI or IMPS, but availability varies and changes, so check the exchange's own deposit page.
- Buy USDT (spot market or instant buy). Check the price and the fee before confirming.
- Withdraw the USDT to your L-Pesa address (see below).
Why this is safer: your rupees go to a KYC'd, documented platform account, not to a stranger, which lowers the risk of receiving or sending "tainted" money.
Option 2: P2P with UPI (understand the risk first)
On P2P boards you pay another person by UPI while the platform holds their USDT in escrow. Binance P2P, for example, has an INR + UPI market and a step-by-step guide (Binance P2P UPI, how to buy on P2P):
- Verify your account and enable 2FA → P2P → Buy → USDT → INR → UPI.
- Choose a seller with a good completion record, place the order, and pay the exact amount to the UPI ID shown inside the order.
- Tap "Transferred, notify seller" only after paying. Use Appeal if the USDT isn't released.
The big India-specific risk: bank account freezes. If the money in a P2P chain comes from a fraud victim, police can freeze the accounts it passed through, including innocent traders' accounts (CryptoRank explainer). The risk is highest when you sell USDT for INR. To reduce it:
- Pay only from your own account. Never accept third-party payments (Binance: common P2P scams).
- Prefer a registered exchange (Option 1) over P2P for larger amounts.
- Avoid many rapid small P2P trades, and keep your order records and chats.
Move your USDT into L-Pesa
- In L-Pesa, open Wallet → Receive, then choose the network (for example Polygon).
- Tap Copy to copy the address, or scan the QR code.
- On the exchange: Withdraw → USDT, paste the address and pick the same network.
- Send a small test first, then the rest. Transfers on the wrong network can be lost for good.
Why L-Pesa? You can hold USDT on Tron, Polygon or Solana and USDC on Solana, send to other L-Pesa users, and swap inside the app (l-pesa.in).
Tax: 30% + 1% TDS (not tax advice)
- Flat 30% tax (plus surcharge and 4% cess) on income from transferring VDAs. Only the cost of acquisition is deductible (Income Tax Dept: s.115BBH).
- No loss set-off: a loss on one VDA can't reduce gains on another or any other income, and it can't be carried forward (s.115BBH).
- 1% TDS on transfers above the threshold (₹10,000 a year, or ₹50,000 for specified persons). Exchanges usually deduct it, and on P2P the buyer is responsible (Income Tax Dept: VDA taxation).
- New section numbers from 1 April 2026: under the Income-tax Act, 2025 the same rules sit in s.194 (Table, item 4) and s.393(1). Transfers up to 31 March 2026 still use 115BBH / 194S (Income Tax Dept note on Form 141, Finclar summary).
- Moving USDT between your own wallets is generally not a sale, but keep records of every buy, sell and swap. Speak to a CA about your situation.
Regulation in plain words
- Crypto isn't banned in India, but it isn't regulated as a financial product either. Platforms must register with FIU-IND, and FIU-IND has ordered takedowns of unregistered platforms (Lok Sabha answer, PIB).
- Rules can change quickly. Check for updates before large transactions.
Safety checklist
- ✅ Your own bank/UPI account only. ✅ Exact amount, inside the order. ✅ Small test transfer first.
- ❌ Never share your UPI PIN, OTPs, passwords or seed phrase. L-Pesa staff will never DM you first or ask for them.
- ❌ Ignore "guaranteed returns", "double your USDT" and Telegram "OTC" offers.
FAQ
Is it legal to buy USDT in India?
Buying and holding crypto isn't prohibited, but it's taxed as a VDA and platforms must register with FIU-IND. It's unregulated, so you have limited recourse if something goes wrong.
Is P2P with UPI safe?
It works, but it carries a real risk of bank-account freezes if fraud money enters the chain. A registered exchange is the safer route.
Do I pay tax just for buying?
Tax applies when you transfer (sell or swap) a VDA. TDS is deducted on transfers above the threshold. Keep records.
Which network should I use to send to L-Pesa?
The one you choose on your L-Pesa Receive screen (for example Polygon). Pick the same one on the exchange.
